TERMS & CONDITIONS
PLEASE READ THIS AGREEMENT CAREFULLY. IT SETS OUT THE TERMS UNDER WHICH THE ASCOT MILLINER OFFERS YOU USE OF ITS HATS. BY HIRING A HAT FROM THE ASCOT MILLINER YOU AGREE THAT YOU HAVE READ AND ACCEPT THESE TERMS AND CONDITIONS AND THEY SHALL APPLY TO YOUR USE.
This Agreement is made between you and The Ascot Milliner.
The following terms and conditions apply:
HIRE TERMS (CONDITIONS OF HIRE)
• The hat(s) remain the property of The Ascot Milliner at all times.
• The full hire fee of the hat is payable on reservation.
• Hats are hired per occasion. Hats worn/spotted on anyone else but the hirer will incur the hire fee again.
• Hire periods usually last three days or four over a weekend (Friday to Monday).
• Once a hat has been taken for hire it is considered a hire even if not worn and there will be no refund.
• The Ascot Milliner reserves the right to make substitutes without prior warning for any article that may be unavailable.
• The Ascot Milliner will not be liable for any delay or failure to deliver due to circumstances which are out of its control; or for any damage or injury caused by the misuse of the Company’s property.
• The liabilities of the hirer commence at the time the hired hat(s) are collected from our premises or other location agreed by The Ascot Milliner, and continue until they are returned to the premises or a representative of The Ascot Milliner.
• Cancellation policy: The full hire fee will be refunded for cancellations made 14 days before the hire date. The full hire fee will be retained for cancellations made less than 14 days prior to the hire date.
BILLING
• By signing up for the Service, you authorise The Ascot Milliner to bill you for the applicable fees, per-item or borrowing fees, courier charges, any and all applicable taxes, and any other charges you may incur in connection with your use of the Service.
• If your hat is not returned on the due return date agreed when the purchase was made, The Ascot Milliner will charge you for each overdue day, at the rate set for that hat as stated by The Ascot Milliner, until a return date has been agreed by the customer and The Ascot Milliner.
• The Ascot Milliner may modify the price, content, or nature of the Service at any time. We may provide notice of any such changes by email, or by publishing them on the Site.
HAT CARE AND HIRE RESPONSIBILITY
• Weather is the enemy of the hat and although we appreciate it is beyond control, please care for the hired hat in the rain as you would if it was your own. Keep it under an umbrella at all times when it is raining and be aware of certain fabrics and features of hats being more susceptible to weather damage in bad conditions. The Ascot Milliner reserves the right to invoice the hirer if the item is returned marked or damaged in any way. This includes but is not limited to holes, dents, stains and rain marks.
• Under no circumstances are customers to attempt to clean any hats themselves by any means. If done so, The Ascot Milliner reserves the right to invoice for part or full replacement value of the items and charge you the full amount of any potential lost earnings or incurred costs regardless of whether any damage has been caused.
• If the hat is damaged beyond repair, lost or stolen then the full purchase price would be paid by the hirer. The replacement cost will be determined by The Ascot Milliner.
• Damage to property: If damage exceeds normal wear and tear, as determined by The Ascot Milliner in its sole discretion, you agree that The Ascot Milliner may charge/invoice you for the full cost of replacing the hat as well as charge you the full amount of any lost earnings or incurred costs resulting from the damage. The product replacement fee will vary depending on the specifics of each hat and its amount is to the full discretion of The Ascot Milliner.
• Should a previous hirer not return a hat you have booked to hire or it is damaged, The Ascot Milliner will endeavor to find a good and suitable replacement. A direct replica style and colour cannot be guaranteed. Liability is limited to the return of the hire charge if a suitable alternative is not available.
• If returning hats by post/courier hats must be posted securely and insured to the value of the hat, please do not tape directly to the hat box and use a tracked service.
• Customers are required to check their order carefully and ensure it’s in the correct condition before leaving The Ascot Milliner premises with the goods.
• All original hat boxes must be returned with the hat hired. Customer will be liable to a £10 charge to cover the cost of replacing any hat boxes not returned.
ADDITIONAL CONDITIONS OF HAT HIRE AT ROYAL ASCOT
• The full hire fee of the hat is payable on reservation.
• During Royal Ascot the hire period that hats are hired is for one specific race day only, unless agreed otherwise. This hire period can be flexible depending on availability as agreed between the hirer and The Ascot Milliner.
• Any hat(s) not returned by the mutually agreed date/time will be charged another day’s hire for each day thereafter that the hat is not returned.
• Cancellation of a booking is required no later than 1st June for no charges to take effect. Notice of any less will result in the full hire amount being charged, however you can swap your hat at any time to a hat of the same value. Once a hat has been taken for hire it is considered a hire even if it not worn and there will be no refund.
